Welcome to GigTry. These Terms of Service ("Terms") govern your access to and use of the GigTry platform, website, and services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using our Services, you confirm that you accept these Terms and agree to comply with them. If you do not agree, you must not use our Services.

2. Description of Services

GigTry provides an online platform that offers access to various AI-powered tools and services ("AI Tools"). Our Services allow you to:

  • Access a library of AI Tools for content generation, analysis, and various professional tasks
  • Purchase credits to use AI Tools on a pay-per-use basis
  • Manage your account, credits, and usage history
  • Access support and documentation

3. Account Registration

To use certain features of our Services, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Keep your password confidential and secure
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use of your account

4. Credits and Payments

4.1 Credits

GigTry uses a credit-based system. Credits are a form of virtual currency used to access AI Tools on our platform.

4.2 Purchasing Credits and Subscriptions

Credits and subscriptions may be purchased through our platform using accepted payment methods (card via Stripe, or PayPal where available). All prices are listed in US Dollars (USD). Prices are exclusive of taxes unless stated otherwise; depending on your location, VAT, GST, sales tax, or similar indirect taxes may be added at checkout and remitted by us or our payment processors. For subscriptions, you are billed in advance on a recurring monthly basis until cancelled, and you may cancel at any time from your account settings - cancellation stops future billing but does not retroactively refund the current period except where required by law.

4.3 Credit Usage

Each AI Tool has a specified credit cost per use. Credits are deducted from your account balance when you use a tool. The exact cost will be displayed before you confirm use.

4.4 Refund Policy

  • Credits are non-refundable once purchased, except as required by applicable law
  • Starter credits are provided for trial purposes and have no cash value
  • If an AI Tool fails to produce a result due to a platform error, we will refund the credits used

4.5 Expiration

Credits do not expire as long as your account remains active. Unused credits remain in your account until used.

5. Acceptable Use

You agree not to:

  • Use the Services for any unlawful purpose
  • Generate content that is harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
  • Attempt to gain unauthorized access to any part of the Services
  • Use the Services in any way that could damage, disable, or impair the platform
  • Reverse engineer, decompile, or disassemble any part of the Services
  • Use automated means to access the Services or collect information
  • Resell, sublicense, or redistribute the Services without prior written consent
  • Generate content that infringes on the intellectual property rights of others

6. Intellectual Property

6.1 Our Content

All content, features, and functionality of the Services — including but not limited to text, graphics, logos, and software — are owned by GigTry and protected by copyright, trademark, and other intellectual property laws.

6.2 Generated Content

Content generated through our AI Tools is provided to you for your use. You are responsible for reviewing and editing generated content before use. GigTry does not claim ownership of content you generate using our Tools, but we retain a limited license to use generated content for service improvement and quality assurance.

7. Limitation of Liability

To the maximum extent permitted by law, GigTry shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from or related to your use of the Services.

8. Disclaimer of Warranties

The Services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied. We do not guarantee that:

  • The Services will be uninterrupted, timely, secure, or error-free
  • The results obtained from AI Tools will be accurate or reliable
  • Any errors in the Services will be corrected

9. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last Updated" date. Your continued use of the Services after changes are posted constitutes acceptance of the modified Terms.

10. Termination

We may suspend or terminate your access to the Services at any time, with or without cause, and with or without notice. Upon termination, your right to use the Services ceases immediately. Unused credits are forfeited upon account termination.

11. Consumer Withdrawal Right (EU/UK)

If you are a consumer in the European Union or the United Kingdom, you generally have the right to withdraw from a distance purchase within 14 days without giving a reason. For digital content (including credits and subscription access), you may expressly ask for immediate delivery and acknowledge that, once delivery begins with your consent, you lose the withdrawal right once the content is fully supplied. At checkout for EU/UK customers, we ask for this consent explicitly; if you do not consent to immediate delivery, withdrawal rights apply as described. This right is in addition to, and does not affect, your statutory consumer rights (for example, under the EU Consumer Rights Directive or the UK Consumer Rights Act 2015).

12. Statutory Consumer Rights Preserved

Nothing in these Terms limits or excludes rights you have under mandatory consumer protection laws of your country of residence - including rights as to conformity, fair contract terms, remedies, and access to local courts or consumer bodies. If a provision of these Terms conflicts with mandatory local law, that provision applies only to the extent local law permits, and the remainder of the Terms stays in force.

13. Governing Law and Disputes

These Terms are governed by the laws applicable to GigTry's operations, without regard to conflict of law principles. If you are a consumer, you additionally benefit from any mandatory protections of the law of your country of residence, and you may bring proceedings in the courts of that country. Before filing a formal dispute, we ask that you first contact legal@gigtry.com - most issues are resolved within a few business days. Nothing in this section deprives you of your right to lodge a complaint with a local consumer authority or, for privacy matters, a data protection authority.
